SCOTUS will determine if title VII of the civil rights act protects gay and trans people. The plain language does not mention it as a protected class. Congress tried to amend title VII a few times to add LGBT but this was never successful.

SCOTUS will consider sexual orientation, transgender discrimination under Title VII

I think SCOTUS will say it’s not covered for those reasons.

Even if it is not covered by the letter of Title VII, is it covered by the spirit of the Title VII?

This is a tricky one. I can see an argument that LGBT discrimination is a form of gender discrimination. You don't mind if Ted dates women, but don't like it if Sally does. The only difference is their gender.

On the other had, Congressional intent when the law was passed in the 60s clearly would not have been to cover LGBT discrimination.

Hard to see which way the Court will come down in this. Kennedy is gone, so the court is more conservative now than when they ruled on gay marriage.

What does the A mean in your title? there is getting to be so many letters and sexes I can keep track. Does the A stand for ass grabber if it does I have a new sexual orientation. I just love grabbing my girls ass and I have fantasized about grabbing her friends ass but never did. I am a A and can I get protected status?

If they let this happen, any pervert would be able to invent what ever crazy orientation they want (e.g fisting bareback leatherman) and then get special legal protections meant for minorities.
