According to former acting FBI director Andrew McCabe in his book The Threat the FBI is an 'independent' entity. I had always thought that it was supposed to be under the exec branch, but McCabe says no. And he further says that this is proper and beneficial.
I would allow that, in practice, he may have a point. But it seems to me that many of the problems at the FBI over the years have stemmed from too much independence. J Edgar Hoover in particular carved out his own independent fiefdom, deftly manipulating presidents and congress-critters alike, often through use of oppo research collected by his army of agents.

Doesnt this create too much of a conflict of interest?
The Congress and Judiciary are supposed to exercise oversight to ameliorate conflict of interest. Unfortunately Congress has virtually stopped doing its job.
I would expect it to be part of Judicial, since it's about laws and enforcement.
I've actually been wondering about this lately.
Seems to me the agency that enforces the law should not be in the same branch(es) that makes the laws. IMO it should be something separate, either part of the judicial branch or maybe something completely independent like the Federal Reserve.
