Because it is a federal asset being used in an enforcement tool in a single state.
Wut?! So a US federal law enforcement agency is not allowed to use one of their tools (an unmanned drone) in a US state? Maybe they should operate that drone in China or Canada?
Besides, the airspace that the drone operates is under control of the US government.
what do you call the FBI [federal asset being used in an enforcement tool in a single state]?
As I recall, the FBI has to be invited in by the local LEA. The only times the FBI can move without an invite is when the crime or the scene are federal - on federal property, on Native Peoples' Reservations, & so on.
"The Federal Bureau of Investigation (FBI) is the domestic intelligence and security service of the United States and its principal federal law enforcement agency. Operating under the jurisdiction of the United States Department of Justice, the FBI is also a member of the U.S. Intelligence Community and reports to both the Attorney General and the Director of National Intelligence.[3] A leading U.S. counter-terrorism, counterintelligence, and criminal investigative organization, the FBI has jurisdiction over violations of more than 200 categories of federal crimes.[4][5]"
Not saying they can't do this, but the Constitution is specifically restrictions on the U.S. GOVERNMENT.
No, it restricts the US military. Posse Comitatus act. The border patrol is a law enforcement agency; federal law enforcement and assets are used in state/local law enforcement all the time.

I didn't say it was against any Fed or State laws including the Constitution.
