Private property or not if that couple had shot someone outside of the four walls of their house, and without a strong case for self-defense, they would be in serious trouble. If they were concerned for their personal safety they should have stayed inside the house with the doors locked. Then if there were a forced entry they would have been justified in shooting. But brandishing a firearm while people are walking past your house is (or should be) a chargeable offense. The gal definitely could be charged with brandishing the way she was waving her little .380 around.

The key phrase here is "If someone is breaking into your home". Nothing about being legally justified in shooting someone just for trespassing on your property, or being in your front yard, or even on your porch or stoop. But only if someone is in the process of forcibly breaking into your home.
Missouri is a "stand your ground state" so your "small" attempt to show how smart you are FAILED.
As if you were actually there? If so then you should be testifying as a material witness. Has the DA called you yet?
What he does not know, based on what he has said, is that ALL property within the fence is co-owned by ALL residents who own property there, Therefore the streets, sidewalks etc. ARE HIS PROPERTY and the "peaceful ( what we have seen is how fast these "peaceful" protester can turn VIOLENT with people being shot, looting rioting, breaking windows painting protest words on EVERYTHING and devastation they leave in their wake) protest can turn violent in a heartbeat.
To some of the posters here who have demonized the McCloskeys, all I can say is, taking into consideration the destructive and violent events that had taken place in St Louis and other cities, if you were in their situation how would you have reacted if you saw people you didn't know break down your gate, trespassed onto your property, and verbally threatened to kill you? Keep in mind also that calling 911 would not have helped because police were ordered to stand down, plus if law enforcement officials showed up, they would have done so to investigate a murder of the residents.
You can't blame the McCloskeys for taking the right and lawful steps to get those trespassers off the property, the only wrong I see in this situation is DA Gardener's seizure of the couple's weapons.
We have covered all this already Mike and you have it totally wrong.
1. There is zero evidence that they broke down the gate before passing the McCloskey's house. In fact the only evidence we have is the gate was NOT broken upon entry so we can't say the McCloskey's saw the mob break the gate and felt threatened as a result.
2. They were not trespassing on the McCloskey's property, they were on the road and sidewalk and the McCloskey's do not own the road and sidewalk. I lived in an HOA, that never meant I owned part of the road as was claimed by Quick Enough.
3. The verbal threats from the protesters came AFTER they were threatened at gun point by the couple, the wife admitted this in an interview.

Even the neighbors are appalled by these two threatening peaceful marchers. Many have signed a statement to that effect.
The argument that they might be peaceful now but who knows what they could do in a few minutes is ridiculous. You could say that about anybody.

They would be singing a DIFFERENT tune if the protestors turned into the type of protesters that have been looting, breaking their windows, painting all their houses, shooting GUNS, etc. that has happens in so many other protests. How does one know if these protestors would NOT do what MANY other protesters have done? A single "spark" can set them off.
Exactly, how in the world did they get so crazy? I mean to the point of harming others? Breaking in houses, stealing, rioting, looting and burning down other people's businesses....only proves how primitive they are, and there are so many who have progressed, who have great jobs, CEO's, great leaders, teachers, politicians, and the list goes on and on....no one is surpressing them but themselves.....there are more opportunities now than ever before.
DON'T leave out the over 26 people who have been KILLED!

Great, charge them with trespassing. I'm all for it.
Is it reasonable to fear for grave bodily harm or death because someone is walking down your private street? That's the real question. Brandishing and assault are off the table if she reasonably feared for her physical safety.
I'm betting she won't even be charged.
I'm betting at least 1 of the "peaceful" protesters was armed.
