A few people have tried to use Jacobson v. Massachusetts (1905) as an excuse for Biden's handlers to impose a vaccine mandate on 100,000,000 Americans.

But Jacobson v. Massachusetts was a case about STATE government having the authority to mandate vaccines, not the Fed govt.

In fact, the Constitution never mentions a word about the Fed govt having any authority to mandate vaccines. And the 10th amendment says that if the Constitution doesn't give the Fed govt the power to do something, the Fed can't do it, but "the states and the people" still can if they want to.

Sorry, Joe, you lose.

Has any federal court ruled it is UNconstitutional, or would this be a case of first impression? Not being argumentative here, I am genuinely wondering.

I suspect there will be a number of court cases and they will not support vaccine mandates from the govt.

He is just doing this for show. Nobody takes him seriously about anything. I bet he already forgot everything he said anyway

Not that it matters as myself and my entire family, wife, kids, parents, uncles, aunts, etc are not getting vaccinated. There is nothing joey can do about it

Maybe so, maybe no. It hasn't gone to court yet.

it is unconstitutional BUT the constitution has been violated countless times so we cannot count on the courts, judges do whatever they want and may underlie Bidens pressure, any outcome is possible

and don't forget:
nothing in this world prevents the courts from being corrupt and the Biden lobby will try to buy anyone they can !!!

Slavery occurred under the Constitution, so yes, the gov can and will violate it any time they can, courts will side with the gov in doing so as well.

The truth is that Jacobson is outdated anyway. The same people that wrote that decision wrote later in favor of forced sterilization of poor people to avoid generations of imbeciles.

Want to be associated with that?

For the last 80 years the law has been moving toward the right of privacy (that is what Roe is based on) and right right to bodily integrity.
