here's the problem with your completely rational post.
It relies on those in control acting rational. And the government is clearly not acting rationally, nor considering what might happen down the road.
The government has convinced too many of the vaxxed that the unvaxxed are going to kill them.
Nevermind an unvaxxed person that isn't infected cannot infect you.
Nevermind the fact that, after 19 months this "killer virus" has only been detected to infect ~ 1/6 of the population.
Nevermind that, except for distinct populations, the risk from infection is very low.
What matters is they've been led to believe in the hazard, and the government has given them the ammunition.
And so, should someone get infected in the business - be it employee, visitor, customer - and have a "bad outcome" (missed work/income, hospitalization, death, "long Covid"), then they are going to sue the business. And the lawyers and courts are likely to favor them, because that business didn't follow these "CDC guidelines" to require vaccinations, wear masks, etc etc.
this new variant R.1, in Kentucky, is gleefully infecting people who were already vaccinated. So to try and pretend it's the unvaccinated who are getting sick and passing it along, is wrong. The vaccinated people still catch and shed the virus, all that changes is their immune systems have a better chance to fend off the virus.
The pro CRT crowd have been the ones claiming that ANYTHING that disproportionately affects blacks, is inherently racist. And a plurality of blacks are not vaccinated, even BLM has said this. BLM is promising riots will ensue over these vax mandates, because it singles out blacks. Who are obviously MAGA hate wearing Trump supporters

The serious shame seems to be concentrated in nursing homes, including VA, where in some cases, less than 20% of employees are vaccinated. Most nursing home employees are certified nursing assistants or attendants, not RNs.
There's ~1MM nursing home employees that need to get vaxxed (assuming the 99.5% of nurses, health pros etc would be vaxxed willingly) - the caregivers, food staff, etc.
If they had given them ALL a $10K bonus to stay away if sick, wear masks, and get vaxxed, it would "only" cost the government $10B. That's 1/2% of what we spent on CARES. Imagine if we had done that, and what would have happened to the 136K death count?

Jacobson is still the law of the land: vaccine mandates are 100% legal. If the government orders you to get a shot and you refuse, you can be fined. So far the federal government has let anti-vaxxers slide and has chosen not to fine people, but they certainly could.
Anti-vaxxers' only hope is to get before the Supreme Court and ask that Jacobson be overturned. That outcome is probably unlikely.
Bottom line: You have the right to refuse the vaccine.
But your employer or any establishment also has the right to require vaccination as entry requirement. Their right to protect themselves does not infringe on your right to refuse the vaccination.

That might hold a tiny morsel of legitimacy if the vaccine actually prevented infection and or transmission. But since it does neither, and that fact is acknowledged by all parties, from the FDA, CDC and the pharmaceutical companies producing them, then the entire premise of treating the unvaccinated differently is not only irrational and unjustified, but also a violation of the law, because of the Constitution’s “equal protection under the law” for all citizens.
Its also a violation of labor laws, governing workplace discrimination, as well as privacy laws which prohibit anyone, including employers from demanding employee medical records. And lastly, its a clear violation of International Law which requires “Informed Consent” with consent defined as freely given, without coercion, pressure, deception, or fear of loss.
So, the bottom line is, the Judge is a criminal.
