The basis of the challenge is that OSHA lacks the power to issue a vaccine mandate for businesses.
However, republicans previously argued that OSHA has the power to issue such health and safety mandates. So it will be interesting to see the states challenge a precedent set by republicans in the federal government. If successful, it could be the end of OSHA and perhaps a whole series of laws passed by republicans under commerce law.

This is, or should be, solely based on Law and the authority granted to OSHA.
Right is right and Law is Law regardless of political origins.
I don't see how it would end OSHA at all.
This is a general health issue and not a work site specific problem. Never before has OSHA issued a rule for medical procedures/ injections.
This would not have come to be if not for the Administration attempting to do something they have no aythority themselves to do.
As in the FBI contractiong with others to do things which they themselves are not permitted to do.

That's not true at all. OSHA requires the Hepatitis B vaccine for certain occupations.
The Covid requirement is a bit different, however. It requires employers to make sure employees are tested and allow employees to opt out of testing by getting vaccinated. There is no such option for the Hepatitis vaccine requirement.

There's no mandate in place so you got fired for failing to comply with your employer. Not because your employer was complying with OSHA. Your situation is different than the Supreme Court hearing discussed in this thread.
Your former employer has the freedom to choose who they hire and fire. Just like you have the freedom to choose who you work for. Btw, the vaccines are now FDA approved and not experimental.

BioNtech is NOT "APPROVED", and is what is only available under "EMERGECY" measures.
"Corminaty" is NOT AVAILABLE, just like the LONG TERM SIDE AFFECTS of these POISONS being administered!!!

That is an Occupationall threat of exposure, not a general public health threat.
Whereas the vaccinated can an do carry and spread Covid where is the reconciliation of no testing mandate for those? So certainly not a "opt out" that makes any practical sense at all.
This is a free pass to allow the vaccinated to bring Covid to the work site carte blanc and illustrates the folly of using OSHA to mandate vaccines.

Corminaty is just the brand name for the BioNtech/Pfizer vaccine. It's approved. This has been clarified repeatedly.
