Sotomayor has diabetes, a condition that puts her at high risk for serious illness, or even death, from COVID-19. She has been the only justice to wear a mask on the bench since last fall when, amid a marked decline in COVID-19 cases, the justices resumed in-person arguments for the first time since the onset of the pandemic.

Now, though, the situation had changed with the omicron surge, and according to court sources, Sotomayor did not feel safe in close proximity to people who were unmasked. Chief Justice John Roberts, understanding that, in some form asked the other justices to mask up.

They all did. Except Gorsuch, who, as it happens, sits next to Sotomayor on the bench. His continued refusal since then has also meant that Sotomayor has not attended the justices’ weekly conference in person, joining instead by telephone.

Fantastic. We need to stop catering to the unreasonable psychoses of the COVID cultists. Good on Gorsuch.

I think the rapid spread of Omicron, amongst the vaccinated and unvaccinated, proves that masks don't do much...

Sotomayor needs to wear a mask -- a catcher's mask -- at dinner, to cover her lie hole and reduce her caloric intake. She's morbidly obese, so that complicates things for her and covid. And at 67, the only 'burpees' she's doing are those that happen after she shotguns a 2-liter Mountain Dew.

Sotomayor can be vaccinated and wear a proper N95 mask, which makes whatever anyone else does irrelevant to her.

When will the left understand this? It doesn't matter what everyone else does. It only matters what you do to protect yourself, such as eat right and exercise, both of which she obviously does not do.

Science has spoken.

Many vaccinated people don't wear masks because either they don't want to by choice and/or feel they don't need to since they're vaccinated. Remember the messaging from the Biden camp that masks are only required for unvaccinated people.

Can't they just move her seat so she's not next to Gorsuch any more?

That's ok. Not like being there for oral arguments would actually change her position. She's made up her mind and can just phone it in.

Yes, one would think they could sit on opposite sides of the room. But that would be too simple a solution. Another too simple solution would be for Gorsuch to be a mensch and wear a mask during their one hour sessions together out of respect for a fellow jurist's needs.

Most people aren't wearing masks and if they are, they are not wearing them correctly.

I think she should continue to teleconference. Many groups such as school boards continue to have meeting with members on Zoom or speakerphone. It doesn't give me much confidence in Gorsuch that he is so ignorant to wear a mask.

The CDC should've have been promoting N95 masks long ago, and all organizations such as schools and stores should've been requiring the correct use of masks. This idea of covering your face with a scarf contributed to our current situation.

the story is not complete enough, regrettably but unsurprisingly.

Yes, I'd like to see the masks they were wearing - had they been individually fitted for N95's at least? Why not move them far apart? Why not actually find out how many vaxxes each has received, and cite the statistics for TREATED diabetes (it's not that big of a risk factor).
