I don’t agree with charges for the pusher, in the heat of the moment under the influence of adrenaline he made an error. The cop who filed a report saying the old guy tripped, that cop should be fired.

I've watched the video a couple times.
What was Gugino trying to do, does anyone know, when he appears to be trying to touch the cop's gun? I would think after being told to back up, and he comes forward in what seems to be a clear attempt to make contact with his weapon, he'd expect to be shoved.
For me, it's less about the shoving and more about the officer starting to kneel to check on him being pulled up from doing so and then the false report.

Someone said he was trying to return a helmet. It looks like the cop tried to help the guy then he was pushed away by another cop.
There is already a thread on this so you might want to have this merged. As an aside the Mayor of Buffalo has now come out and changed his stance a bit on the situation he condemned today as other facts have come to light. See everyone jumps to conclusions and ASSUMES and then you have to back track.

There is a female police voice telling a bystander, who had yelled you better call an ambulance, that "the EMT is right here".
Reading through articles about Martin Gugino, he is a very very frequent protestor for a variety of causes, one of which is Plowshares. I just would think he would know not to approach a group of cops in riot gear and reach out (albeit slowly) for his weapon.
Walk up to a cop and start shoving something in his belly close to his/her firearm and what do you expect? I wonder if this was staged. Just happens to be a camera right there when this guy walks up? What did he think was going to happen?

Look closely at the old guys hands, they are both full. He wasn’t reaching for anything.

He has a helmet in his left hand and a cell phone in his right.
