Rios-Gonzalez, who works as a TSA agent, ...
9NEWS has learned the Fort Lupton Police Department has submitted a felony summons against the suspect to the Weld County District Attorney for review.
"It is easy to look at this going backward saying they shouldn't have parked on the train tracks in the first place. But, they have a certain position they want that vehicle," said Richard Kolko, a retired FBI Special Agent.
...
"Certainly something as simple as putting them in a car parked on railroad tracks, even if the car had been parked there for the initial traffic stop, the officer should have said, 'Hey, I need to move this car and put it in a safe spot,'" he continued. "Because that assures the safety of the person in the back seat."
Seems they were going by the book in where they had stopped relative to where she'd stopped, but they should have moved the vehicle before putting her into it.
The cops will probably be fired, and rightly so, and one or more may be charged.
It's great that she'd survived. She will likely receive quite a lot of money from this.
Unknown at this point if she had been involved in, or caused, the alleged road-rage accident that led up to this.
Both of them. You've figure one of the two would have enough brain cells firing to have not stopped a car on the tracks, not put a suspect in the back of a car stopped on the tracks, or pulled said suspect out of the car stopped on the tracks when they heard the train blasting its horn. Nope.
How stupid does one have to be to park their car on the tracks, apprehend someone, put them in the back of the car that is on the tracks, and then leave it there while they search the person's car?
They just take anyone these days to be a cop? I can't even begin to understand the level of collossal stupidity it takes to a) park on the train tracks b) put the suspect in that car and leave it on the tracks c) pay zero attention to the horn blaring as the train barrels down the tracks towards the car.
The good news is, she survived, however, she has a lot of injuries:
They better be charged. They put her life in danger over an alleged 'road rage' call, which they have yet to prove. They should spend time for putting her through this, and a long sentence for being this stupid!
It cannot be homicide if the suspect is still alive, and at least as of this post, she is. Criminal negligence is what this officer should be charged with...

Woman handcuffed in police car hit by train... and survives
Seriously, why the Platteville police parked, for some reason that is baffling to conceive, directly on the grade train crossing???
Bodycam footage has captured the moment a train collided with a police car in Colorado... with a woman handcuffed in the back seat.
It took two other officers, who had been searching the woman’s pickup truck for weapons, at least 15 seconds to react to the train barreling toward the police cruiser while blasting its horn, warning of a coming collision, according to the video footage.
One officer screamed an expletive as they realize a Union Pacific train is coming toward the parked patrol vehicle. The other yelled for his colleague to “stay back,” the footage shows.
The other officer turned back and forth a couple of times as the train approached, police camera footage shows. He ultimately turned and ran for cover behind the police car.
By far the most disgusting, gut-wrenching part of the video is the officer standing guard over a bound woman with a rifle who then runs for his own life due to officers’ bad choices.
The victim is still hospitalized after suffering brain injuries and broken bones in the crash. It's a miracle that she survived the crash.
