I think this guys heart is in the right place but his actions were wrong. He isn't being punished for wanting to help people but for breaking many rules and regulations in his attempt to do so.

It is a hard question. By providing aid and comfort, you are enabling them to break the laws of the USA and sneak into the country. On the other hand, water is a pretty basic stuff so I would say NO to jail for water but YES to jail for housing and employment!
