Other, the kid was wrong and punishment is in order but he isn't a "horrible criminal" like the OP states.

Crappy poll choices IMHO.

Alright. So all three of you view it as a felony assault.
I'm sorry about the poll not having better options.

I don't know what the definition of Felony assault is in Austin.

Felony assault may be a bit much, but he deserved to be arrested and charged, IMO.

Did I say felony? How do you infer such a thing?

Generally, assault is defined as intentionally, knowingly, or recklessly injuring or threatening to injure a person or the person's spouse. Additionally, assault includes intentionally causing physical contact with another person if the offender knows the physical contact will be offensive to the victim.

Under Texas law, assault is a misdemeanor

It said in the article that he was arrested for a felony. Please read the article first.

Based on that law, assaulting a Government employee while they are on duty elevates it to Aggravated Assault, so yes, looks like tough for him, it will be Felony Assault.

I don't feel sorry for him, he should not have assaulted her while she was merely trying to do her job.

And I voted "other" stating only that punishment was in order, not that I agreed with the article, or the charge.

The student had no right to have a phone in school and had no right to grab a teacher.
Im Not sure about that. I agree it should not be open during a Math test. But I believe students have a right to have cell phones in school.

This should be about the assault on the teacher not the cell phone.
