I don't know what the definition of Felony assault is in Austin.
Felony assault may be a bit much, but he deserved to be arrested and charged, IMO.
Quote:
Generally, assault is defined as intentionally, knowingly, or recklessly injuring or threatening to injure a person or the person's spouse. Additionally, assault includes intentionally causing physical contact with another person if the offender knows the physical contact will be offensive to the victim.
Based on that law, assaulting a Government employee while they are on duty elevates it to Aggravated Assault, so yes, looks like tough for him, it will be Felony Assault.
I don't feel sorry for him, he should not have assaulted her while she was merely trying to do her job.
There is a no cell phone policy at the school - students know this and know phones will be confiscated.
When the teacher went to confiscate the phone - the student grabbed her hand hard enough to make her drop the phone.
The student had no right to have a phone in school and had no right to grab a teacher.
Im Not sure about that. I agree it should not be open during a Math test. But I believe students have a right to have cell phones in school.
This should be about the assault on the teacher not the cell phone.
