U.S. District Court Judge Clay Land has thrown out a complaint questioning the president's birth from
an Army captain fighting deployment to Iraq and gave a warning to her lawyer, birther maven Orly Taitz.
Land also put attorney Orly Taitz, who represents Capt. Connie Rhodes and is a leader in the
national "birther" movement, on notice by stating that she could face sanctions if she ever
files a similar "frivolous" lawsuit in his court

ok, but the soldier in this particular case is claiming that she doesn't have to go to iraq because obama isn't a legitimate president.

she is not opposed to the iraq war; she explicitly stated in court that she would have no problem deploying if bush was still president or if mccain had won.

this thread isn't about whether we should be fighting in iraq. it's about this particular lawsuit which would be the same whether or not we were at war.

UNITED STATES DISTRICT COURT
MIDDLE DISTRICT OF GEORGIA
COLUMBUS DIVISION
CAPTAIN CONNIE RHODES, M.D. F.S.,
Plaintiff,
COLONEL THOMAS D.MACDONALD,
GARRISON COMMANDER, FORT
BENNING, GEORGIA,
GEORGESTEUBER,DEPUTY
COMMANDER, FORT BENNING,
DR. ROBERT M. GATES, UNITED
STATES SECRETARY OF DEFENSE,
BARACK HUSSEIN OBAMA, de facto PRESIDENT of the UNITED STATES,
Defendants.
Each of those 4 defendants required legal representation.

The California case, not yet resolved, used a shotgun approach to naming defendants and includes Hillary Clinton, Nancy Pelosi, Bill Gates, Joe Biden and Michelle Obama even though no claims were made against them in the filing. That's going to be one huge legal bill against Taitz if costs are awarded.

http://nativeborncitizen.wordpress.com/ is a great resource for all birther legal motions. (it even has a few links back to our threads here at city-data)

Awarding costs seems only fair.......in so many ways! Maybe Taitz will learn something about filing lawsuits after all.

It'll be about $100,000.

I remember in one other case, don't remember the lawyer but I think it was Berg, the costs awarded to the defendant was only $562.00 but as I said I have no idea what the costs in this one will be.
