The Constitution gives Congress the power to regulate commerce among the states.

The Supreme Court has long held that this authority reaches all economic activity. The court has recognized as legitimate exercises of the Commerce Power the authority of Congress to prohibit the growing of a few marijuana plants on a window sill for personal medical use or to outlaw a doctor's performing of a partial-birth abortion.

Choosing whether to buy insurance or impose your health care costs on others is economic activity subject to that authority.

Virginia has passed a law purporting to nullify the federal law. But the Supremacy Clause of the Constitution provides that federal law is the supreme law of the land. Virginia's law is no more enforceable than were its laws attempting to nullify federal desegregation laws in the 1950s.

I am from Virginia. Like most states, we are in terrible shape financially, lacking money for schools, roads or health care. We cannot afford bankrolling frivolous lawsuits.

It's awfully soon to be proclaiming that.

So you found an article that says the challenges won't hold up. I can find you (or you can use your awesome Google fu to find them yourself) several articles that say that they have a solid foundation. There's even a couple of SC decisions that support them.

It's easy to cheer-lead anonymously online for our own teams, but the reality is that it's not that cut and dry. If it was actually reasonable for you to proclaim what you did, then the states wouldn't have bothered. If the states winning was a slam dunk, then the bill wouldn't have been passed.

This is going to play out in full, and it's going to be a while before we have any idea which way it's going to go.

Boy these right wingers sure are looking for "activist" judges these days.

They can't win at the ballot box.... More people approve of the health care bill than don't.

Fun times for a liberal watching them squirm.

Most of the mainstream media is just a mouthpiece of the democrat party. They exist not to report on events, but to spread propaganda.

This isn't about CNN having some crystal ball that it knows the future, it's that it's become a White House spokesman or Pelosi's spokesman.
