U.S. District Judge James Zagel turned down a request by former governor Rod Blagojevich to subpoena President Obama, stating that based upon the evidence presented, the President would have nothing material to say on the witness stand.

Obviously the "dirt" was exculpatory enough to be relevant to his defense, so I will consign this dirt to the same dust bin as the super secret soon to be displayed Michelle Obama whitey tape.

The article clearly stated that the judge denied the request to issue a subpoena due to lack of evidence that Obama would have anything to say that would be material to the trial. So, what's the big deal?
