I have a piece of property in Port Charlotte and I live in NY. I was going to sell but it buyer backed out due to the neighbors boat dock looked like it was on my property and I would interfere with his boat. So, i had a survey done. By code he should be 5 feet off boundary line and he’s dock is only two feet and Boatlift and canopy is a half a foot over boundary. I called the town regarding this, they told me it was my problem. Adam did give me his permit information and his dock design. The plans he submitted for his boat Dock to the town is not what he installed. He’s against code. Boat dock was finished in 2020. What is the timeframe in Port Charlotte Florida for me to take him to court and get this corrected? I do believe that people that are also in violation of this should be the contractor and a big part is the town. They had site plans so how can they finalize and approve this when what was installed was not the same as what was submitted to them?? When they have to do a final site visit? Thank you

It’s actually the county’s problem since they approved what wasn’t planned.

^^^this, but you might need a Lawyer to get them motivated to take action. Hire a Lawyer who has experience in this specific area, not just any Lawyer will do. The local Bar Assn. should be able to refer you to one.

When I had my boat dock replaced, the county sent out four different inspectors (or was it five?), one of which whose only task was to make sure that it was set within the proper distance from the property line. Sounds like one of the inspectors got a little sloppy with their work.
