Prior to moving into an apartment there is an inspection report. It's a checklist. You and the inspector go through each room of the place and also test all the appliances. You the tenant need to make sure you note any and every pre-existing condition prior to moving in. Carpet stains, torn carpet, bathroom tile, kitchen tile, countertops, stove, refrigerator any dints and dings, etc. and make special notations on the checklist if the items aren't mentioned. You and the inspector both sign off on this checklist and if the items aren't repaired prior to move-in then at the end of term these items are pre-existing conditions. Make sure you keep a copy of your inspection report. When you move-out you should always be present during their final inspection of the place.

Actually, yes, those are normal charges. Anything that is not normally done to an apartment upon move out is considered to be outside of normal wear and tear. Smoking, while allowed, isn't considered a "normal" activity as far as normal wear and tear are concerned. If there is an odor lingering from a previous resident, the landlord will have to go through measures to remove it as it's a health concern for future residents. The costs of doing so are always passed on to the resident.
