Is it common to use a real estate attorney when buying or selling a home?
Please tell me how necessary, or not, it is to have legal representation involved in simple purchase or sale of your home. I am in S. Florida if location makes any difference. Thank you.
I do believe FL is like most of the South and Western US where an attorney is not normally involved. Our state TX has simplified the process and the Title Work is done by the Title Company (owned by attorneys).
It's a whole different process than you see in the Northeast where the Attorney brings the parties together to close and reviews the contract.

In Florida, closing transactions are not usually handled by Real Estate attorneys but it is always an option that can be selected. IMHO, it is not required with an experienced Realtor, at least from my experience as a former Realtor until 2014.
I’m in the Sarasota area. It’s not unusual to have an attorney be your closing agent but I’d say it is more common that a title company handles the closing. I would never encourage anyone to not use an attorney but it will cost more. Sometimes it’s worth it, though.

I agree that in Florida that most transactions are handled by a title agency. I only had one transaction that the seller insisted on using a Real Estate attorney for the closing at their own cost, I represented the buyer. I never discouraged a single client from using an attorney though.
No one needs an attorney... until they do. Right?
Buyers need an attorney far more than they need an agent.
There are very few home buyers who won't benefit from having THEIR CHOICE
involved early on to review offer contracts and assist generally -as needed-
and then to manage the closing when you get that far.
And NO it won't cost more than other approaches...
like having the agents/sellers/lenders use their choice.
(as is rather common out west)
