I am purchasing a condo/townhouse. The parking in the development is horrendous and I am assigned one parking spot. If I get company they need to park outside the development and walk through it at least a half mile to get to my house. My backyard borders on a main road with lots of parking. I noticed that many of the houses in the development bordering that road have gates in the fence and park there. My children all have babies and when they visit the have a lot of bags, carriages,etc.
I want to do the same. I was not even going to ask the Board but I didn't want to start off on the wrong foot so I got in touch with the management company and asked how to get permission. They told me to email why I need the gate and not to say it was for parking. I wrote a letter and stated that my handicapped daughter gets picked up by a van and it's too far for her to walk alone. She's mentally challenged and fine physically.
I was turned down and the management co sent my attorney a letter saying I need to sign a statement saying I won't put a gate and if I do they will fine and sue me. They said my backyard borders on common areas. It is the same where the other houses have their gates so I'm not understanding
What can I do? Can I sue them? What do you experts suggest?
I told the management company I haven't closed yet and they said to ask now.
I am on the condo board where I am now and I see how arbitrary they can be. This is what concerns me. A lot of board members like the power and just say no to a reasonable request.
If nobody else had gates I wouldn't say a thing if denied but about 6 of them right near mine have them.

What penalties will you have if you decided to get out of your contract? Like other posters here, I would not move into any community that I had valid concerns about even before closing. The problems only get worse not better. I would rent a place for a while and take your time looking for the right community for you...one which fits your needs better. And before closing on such a property, I'd ring the doorbells of several residents and ask how resposive or arbitrary the HOA is. The worst thing would be to close, move in, and be so miserable that you wind up selling and moving on.
How did they justify turning you down when neighbors have them? Did you ask what justification those owners had? You only get one parking space? Is that all the spaces anyone has? are there any visitor spaces?
They haven't justified anything to me. I'm going to push it with the management company. The guy I spoke to was going to look at the property today to see why I was turned down. There's one assigned spot for me and in the area there are 2 guest spots. I was told good luck trying to get to use one of them..they're always in use.
I can't get out of the contract. There is no mortgage contingency because I am not getting a mortgage. There is no out unless I'm willing to forfeit my down payment.
I just thought I could threaten to sue or push some weight around.
