I don't understand how the fence is keeping you from regrading your yard and adjusting the pavers. Also if I were you I'd hire someone to do that for you if it's done incorrectly you will have major issues.

You can do whatever you want with a fence that is entirely on your own property.

Surveys are sometimes inaccurate so do be careful, though.

This isn't remotely a title issue in any way, shape, or form.

I'm also having trouble trying to picture your grading/paver issue. My backyard sounds somewhat similar to yours, the fence line is shared with the next couple of houses but our property line actually goes past the back fence a bit. Unlike you, I have no neighbor behind me, just some city green space and then rural farm property, so I can just go behind the fence and do what I need to do and it's NBD.

I think I understand what the OP is trying to say....


Before he purchased the house the previous owners installed pavers and a paver retaining wall around the property.

When the previous owners installed the pavers, there was probably a nice big house behind their lot that was sold to developers who tore it down and built attached homes.

Then the builder puts up a fence for the attached houses...

and the fence the builder installs is a foot or so into the OP's property line leaving the paver retaining wall on the side of the fence that borders the attached houses.

and the OP is concerned because he doesn't have access to the retaining wall, and/or those neighbors will remove it.

I think..

I could be wrong...

or maybe the gypsies did it.
