extra $1500 for agreement we had with the seller for his washing and dryer. I thought it was included in the mortgage. Now 1 month later after closing they are demanding me to pay. I've already spend money on remodeling and don't have free cash right now. What should I do and what are the consequences in I can't pay right of way?
I recently ran into a similar situation on our last purchase involving about $3500 in improperly allocated property taxes (detected a few weeks after the sale was completed). I promptly paid the seller that amount.
The question is, 'Are they correct?' If so, you mistakenly spent $1500 that wasn't yours and should rightfully pay the seller what he is owed now. "Not having the free cash at the moment" does not reduce or eliminate your immediate obligation. If you truly cannot raise the $1500, you should return the washer and dryer to the seller ... along with a sincere apology.
Not to take this discussion off track, but you paid $1500 for a set of used laundry machines? You can buy some pretty nice brand new machines for that kind of money.
Anyway, jghorton is right. If you agreed to pay the money then you need to pay it. Perhaps if you don't currently have the cash available you can arrange a payment plan with the seller.
It's just as much your responsibility to understand what you're signing at the closing as it is your attorney's responsibility to explain it to you. If you had read and understood your HUD then it should have been obvious to you that you needed to run home and get your check book so that you could pay the seller this money.
You agreed to buy the sellers' washer and dryer for $1,500, so pay them. Period. Surely you can scrape up the money somehow.
Next time, make sure to read and understand your sales contract and your closing statement. (Plus, you might want to think twice about how much you pay for any personal property.)
Since its in the contract, its pretty easy for them to bring you to small claims court and win, plus court costs. Talk to them, work out a payment plan before it goes to court.
If your HOA didn't send out notices for payment, do you think you don't still owe your HOA dues on time? If your credit card bill got lost in the mail, do you think you don't still have to pay your credit card payment? If you don't receive your first pay voucher from your lender from buying a new house, do you think you get a free month of living there without paying your mortgage, or do you go ahead and pay it to make sure you're not late?
You were able to purchase a house which means you're an adult. Adults have responsibilities that they aren't always reminded about, but you are still obligated by those responsibilities. Put on your Big Boy/Girl Panties and pay the sellers what you owe!

You knew at the closing that you should have brought the $1500, and you're saying you spent it on remodeling anyway, right? Sure sounds like you had this planned out.
Guess you'll be hocking some jewelry or your car's title to come up with the money, because that was a legally binding document, and they can sue you.
