What are you waiting to get you own survey and finally put this matter to rest? It's been almost a year and you are essentially in the same spot as when you started this thread.
Thanks, appreciate the advice from all of you. I don't think I can afford to take the risk of spending money on the survey and appraisal right now. I do like the idea of splitting it with my neighbour and buying more space for my garage area.
How are you going to agree with your neighbor about the new boundaries and the space to divide if you don't even have your own survey to see what the current lines are?

Huh? Strange wording. I'll let you read all 21 pages so you can see where things are currently at because I'm not in the same spot.
I think they are saying what I'm thinking. You will never have the peace of mind you will have when your get your own survey unless... wait for it... you GET YOUR OWN SURVEY.

The situation has changed because the vacant lot owner is offering to sell the land to me. Prior to that my title company advised that they will pay for the wall (don't laugh) once the neighbour has provided a recorded survey. He never did that. Mid last year he said he'd start building the property around November and then he disappeared. He nor the county contacted me or my neighbours notifying us of a new construction. Now he's offering to sell the land to me.
has it really changed? you're not even sure if there is encroachment as your neighbor claimed . If the offer is serious, how will you assess if the price is fair? are you going to pay for an appraisal?
Why would you pay for land that may already be yours, rather than a survey that could very well prove that it is yours, either by title or by an easement? I don't understand your reasoning.
The lot owner had a property survey done and moved the fence to the property line. I did not pay for anything.
Glad to hear that it is taken care of and you don't have to deal with it anymore.
