Some of you may remember my last HOA thread. Some of you said I was wrong. No biggie. Things have gone a little further down the tubes.
HOA president has decided to solicit bids to maintain property we don't own, against the objections of the Treasurer.
HOA president has begun cutting Treasurer out of board business. Thankfully the Secretary has seen fit to Cc her on emails.
President has now lied to several homeowners regarding several subjects. He also approved on-conforming fences.
He's pretty much turned into a gigantic douche. Sadly, there was no turd running against him. (South Park reference for the uninitiated. )
Board has been in place going on 3 months and 2 lawsuits are about to be filed. Let this serve as a warning to those on a board, do things the right way. It'll be so much easier, and better for everyone.
Very good. Sometimes that 's the only way to get someone to learn. Effecting their pocket and a smirch on their name. What are the lawsuits for in general terms?

What does this mean? Who owns the property? Has the HOA maintained this property in the past? If the HOA doesn't maintain it, will it make the neighborhood look bad?
More questions. Why does this property need to be maintained?
What does "maintained" mean? Mowing or something more?
And how can you just go on someone else's property and maintain it? What's the arrangement going to be there?
The owner of the property you don't own but the board wants to maintain....do they have insurance in case the person the board hires to maintain it get injured?
Are you talking about maintaining the commons grounds?
I'll chime in on advice when I have more information. I'm a member of 3 HOAs with 5 properties total. I've dealt with them but so far no major problems.

This guy is obviously not compatible with HOA living.
People that want to live in HOA's typically want the rules. They like the rules. They like the fact that everyone has the same looking house and the lawn is always groomed, etc.
If you cant conform, dont buy in an HOA, they are only made for conformists.
As for the original poster talking about misusing funds, that is another issue. Just a tip, before I would ever think of filing a lawsuit, I would simply write a letter to every homeowner stating what is going on, and the lawsuit that will be filed if nothing is done, and break down the potential cost to each homeowner for this lawsuit. People dont pay attention until it hits their wallets. If you can paint a picture of what will happen and how much it will personally cost them, they will get involved and you can avoid the lawsuit altogether. Yes sometimes lawsuits are needed, but if you can avoid paying scumbag lawyers by sending a simple letter, do it.
