There is a massive new home being being built right next to us.
Our HOA has specific rules regarding construction related activities.
That is, no construction after 7 pm Monday to Saturday and no work on Sundays and holidays.Also no blockage of driveways and mail boxes.I already have had a notice by USPS about the mailbox inaccessibility.
The builder and owner continue to break these rules.I have contacted the owner and HOA multiple times but this persists.Going on for 8 months now....
The owner wants me to prove that these are actually occurring by taking photos.Which I have.
Of course, he regards me as "the bad guy".
The HOA does nothing and I'm in a quandary of what to do next.
Construction time to completion is very slow in our area, more so as this is a $2 million home with an elevator, fancy patio, built in sauna, etc etc.
The arrogance of some of those "with money" really bugs me.
What advice would you give?
(I have a medical condition that is aggravated by noise and commotion.)

FWIW... I was in an HOA development where the developer reatined absolute approval/disapporoval authority for all the rules he himself set the HOA up with. There were a few times he waived a restrictive covenant to ensure the sale of a lot. And since the lot/house weren't subject to the HOA until completed, there really wasn't anything to be done about it.
There's a chance that the builder is the HOA until a certain number of lots are developed. So it could be a situation of the inmate running the asylum.
If your HOA Board is not willing to enforce HOA rules that were properly established, chances are one or more Board members are friendly with the offending owner. What other rules are they not enforcing? Are your HOA finances being properly maintained? Are the common areas being properly maintained? If they are not doing their job, which is to protect, preserve, and improve the common areas, rally your neighbors and vote the Board out at the next annual meeting. Elect HOA members that DO care about what is best for ALL of the owners.
It is ultimately up to the entire HOA membership to oversee their Board, by participating in monthly Board meetings, asking questions, and learning about how HOA's are supposed to be operated.
Board members have a fiduciary duty to all HOA owners, and can be held personally liable if their actions can not meet the "Business Judgment Rule".
The real estate agent that sold the land to the owner is a well known personality in our seminudity of 850 homes.
She sits at the golf course dining room every day and recruits clients (mainly from California) that come up here to buy homes.
She is involved with the HOA and I believe is the culprit in allowing the 3800 square foot home on a 9000 square foot lot....
Many rules are continuously breached-dogs running off leash, fences(not allowed),parking violations etc.
Most people who reside here are generally very passive, a majority are from small cities in the local area.(i.e. very "provincial attitudes " IMO.
They do maintain the common areas and seem to balance their books.
I really believe it is a matter involving a very pushy real estate gent and the type of clients she attracts that is the root of our problems.

Seminudity? Your 850 houses are seminude or the residents are? I'm sooooo confused!

The problem is that the builder has ignored any requests by the owner to comply with the construction rules.
The owner himself is coming by every several days to make sure the building crew does not block driveways,mailboxes and that they quit working at 7 pm.
