I watched speeders and again...a realtor who was caught, not just for speeding but also for illegal drug use and having a warrant out for her arrest....wow what a great realtor.
This is silly.
You are aware that some MDs, attornies, CEO's, librarians, polititions, educators, therapists, nurses, dentists and minimum wage employees make bad choices and manage to get themseves into serious trouble, especially when alcohol and or drugs are concerned.
I always find it amusing when people make blankets statements about the law, like "it's a copyright violation to [post photos from the MLS on a real estate blog in order to criticize them], period, without permission of the copyright holder (in most cases the photographer)." It's amusing not only because it's almost never a lawyer who does it (lawyers are generally hesitant to make blanket statements without being fully aware of all the facts), but also because it's almost never true.
The copyright issue is a great example. This is the case of agents having just enough knowledge of the law to be dangerous. It is absolutely not clear under copyright law that a real estate blogger is prohibited from posting photos from MLS in order to denigrate them. In fact, the copyright law contains a specific exception for reproducing copyright materials for the purpose of criticism (there are also other factors that must be weighed to determine whether it is permissible).
Agents are probably using their understanding that it is a violation for them to use those photos without permission to try to sell the home. But I wouldn't recommend anyone taking the advice of an agent on this one.
You are absolutely correct Austin-Willy. I too hate blanket statemesnts about the law, about a class of people, about a profession, etc.... as soon as we classify, we are wrong.
In this case, I would hate to be the case law to prove it though... LOL!!
