Wait, you are considering allowing them to walk because you are taking a built-in microwave and ceiling fans with you when you leave, or were they not there to begin with? Those are fixtures - even in foreclosures that I've seen, those were always remaining in the house, did you specifically exclude them?

If you are doing a short sale how is it that you have money to pay attorney's fees to sue?

Suing a buyer for specific performance is insanely expensive, which is why most people just take the earnest money and call it done.

It sounds like you swapped out the stove, removed the ceiling fans and microwave.

Did the buyer make this discovery during the final walk-thru, in anticipation of a 7/7 close?

Did the contract exempt the stove, ceiling fans and microwave from the sale?

I was wondering if the seller removed items as well.
