I have my home listed with a broker - i am in a 6 month contract - i am 3 months into right now. I live in a community and we had a open house. My problem - well I came home to check on the open house to find a few things that upset me a great deal. 1- they high lighted the wrong house on the map (would not have been a problem if the agent had been here she could have fixed that problem) 2- one balloon outside but no signs to show who it was listed with, no open house, no for sale, ( ok can deal with that too) 3- i walk in to find that she was not her but out showing other people homes and left her 16 year old and her friend to represent my home. When I spoke to her I said if there was a problem in doing it I would come back from my weeken getaway and be here - she told me she would be here and there would be no problem. These kids did not know anything about my house and where not professional looking. They could answer any questions - all they did was follow people around and watch my tv. I was askinf over 300,000 and she was getting 6%. the community had 30 - 40 people here for the open house but 3 only found mine do to the map and only because my neighbor was outside and told them. I want out of my contract to be able to list with someone else and now I am being told it is up to the broker/owner who is at this time on his vacation. After they killed mine. please does anyone know what I can do.

Your broker sounds like an idiot, and signing a 6 months' contract is really excessive. Being that she left minor children in your home without adult supervision, I would (off the record) threaten to file a complaint with both the broker/real estate licensing board and state youth services if she won't release you from the contract.

Your Broker's behaviror is unprofessional and (to me) inexcusable. If it is a nationally recognized agency (Century 21, Remax, etc.), I would look into a way of pressuring her to let you out of the contract by exposing her lack of professionalism to the "Powers that Be" at the corporate offices of the Realty Co.

The broker has the responsibility to provide adequate supervision of the agents, and is not doing this. Also I'm sure you are not satisfied that they are upholding their end of the terms of the contract.

I would list the things you just posted in a letter to the agent and broker, and state that you are cancelling the listing. They need to cancel the listing as per your request.

You could file a complaint with the local board of realtors, and the state department of real estate.

Wow! As a Realtor I am SOOO embarrassed and offer my apologoies on behalf of the profession. Well, you posted in Feb and it is now April, so I'm sure you've resolved the problem. But, for those who find themselves in this sitution, it is not hopeless.

You don't even have to go as far as going to the board. What I would recommend is going straight to the agent's employing broker and filing a complaint. They could either assign another agent or may even release you from your 6 month contract.

you can terminate your contract for specific performance

I have been on the phone with the manager of the office and was told that the broker/owner is on his vacation and will review the file when he comes back on thursday. I asked her what he needed to review. She then said well "it is a contract and we did advertise. I explained that - that wasn't in question - I have a big problem with what she did for my open house - and reminded her that I wasn't told that a 16 yr old would be showing my home and that I had offered to come home from my vacation to show it myself if she couldn't. There has to be something illegal as far as real estate laws to what she did and not left up to the owner if he wants to let me out of the contract

I am an agent you dont owe her any money because she didnt bring you a ready willing and able buyer just put it in writing it has to be in writing that you no longer wish to have this agent work with you
date and sign it
it is in your contract

yes there is I know for a fact that in GA (and probably elsewhere) you have to be a real estate licensee in order to run an open house unless it is your own home. also you have to be 18 in order to be licensed. also find out which board of realtors she is signed with and trun her into the board realtors have a very strict code of ethics they have to adhere to. she could be in big A$$ trouble.
