In our state , ny a landlord is responsible for the repairs .....the tenant does not have to pay rent for the time the apartment is not habitable but any living costs elsewhere is on the tenant.

f it takes to long the tenant can break the lease with no penalty ..this is why renters insurance is a good idea.

Most states follow suit ...the tenant saves the rent , but the landlord does not have to pay for alternative places to live

I would also add. There is no way carpet cleaning would have cleaned the raw sewage that is soaked into the carpet pat. And under the padding.

This will be a long drawn out process while waiting on the courts.

I would just move for now. And then let the lawyer or small claims court handle.
