Ok, so I'm having a landlord/tenant issue that I really need some help with. I have lived in an apartment for years and recently got a job where I could afford a house. I of course took the first one offered to me because of the lease option to buy. Here's the delima...the house is quite old and needs some work. I was told by the owners that it would be ready for me on the 15th of this month. I gave my 30 day notice to my apartment complex (we are supposed to be moved out by the 25th of this month) and the $1000 deposit to the new landlords. I transfered water and propane (which is a company the landlord also owns) into my name. My children and I moved our belongings into the garage until the work was completed. It is now the 17th of the month and I still have no hot running water, was told there was a leak that needed to be fixed in the wall of the bathroom, a stackable washer/dryer sitting in my dinning room, a broken hot water heater in the hall and my children are supposed to have to live with this? Among the beauty treatment the house needs, the driveway has been opened up top access the water pipes and a couple windows need bars in order to stay open. The landlords want to come in and out to repair the issues while my family attempts to live here. The kitchen floor is warpped due to the busted water pipe they are replacing. In short, the house is not livable with 2 teenagers, an 8 year old and a toddler. What can I do to get my deposit back and move my belongings out without creating a legal situation? All the repairs they are talking about are extensive and the house should never have been listed in the paper as ready to move in. I've held up my end of the agreement...where do I go from here?

Read through your lease agreement, there has got to be something in there that they haven't lived up to that you can use in your favor to get out. Lease to buy is a scam, and is technically illegal. If there is nothing you can find in your lease agreement that will give you an out then maybe see if you can find a lawyer that will give you a free consultation. If all else fails it sounds like it might be worth just getting out even if that means loosing the deposit money. Sorry you are in this situation, good luck I hope you are able to get out.

Did you not view the house before agreeing to this scheme? Warped floors and stuff sitting inside should have been visible. Rent-to-own is usually a scam, most people never complete the purchase, the rent is usually higher than comparable regular rents, and as the "owner" you get to pay for all the repairs and upkeep on a house you will likely never buy. More money for the original owners.

I'm confused. If you are going to buy the house why did you not pay for an inspection? You would then know all about what needed to be repaired.

Sounds like you went in on this with blinders on and you only have yourself to blame. Contact a lawyer to see if there is any loop holes you can take advantage of.
