I moved out of a place I was previously renting last month, and finally received my security deposit refund (with itemization of deductions) two weeks ago.
Yesterday, I got a letter from my bank saying the refund check was returned due to non-sufficient funds. I have contacted the management company to try to rectify this, but have not received a response, yet.
Am I entitled to any remedies in the event that the management company does not respond, or, if they do, is it reasonable to request a money order with the refund amount plus any fees I incurred? The management company has made no suggestion of bankruptcy or any other financial issues that could prevent me, so this seems odd that this would happen.
Well, I just called today so it would be fresh on their list for Monday.
Anyway, given I can request some other form of payment, I think I shouldn't have to worry about any further action, but doesn't hurt to ask in case a situation like this comes up later.
If you have a branch of their bank, hand walk the refused check up to the teller and try to cash it again. it's possible it might go through a second time.
Yes, you should be able to recoup any fees imposed by your bank. They might refuse but a quick trip to small claims court would settle that issue in your favor - plus court costs, so it's in their best interests to pay you now. Remind them that a bounced check is a crime if you need to strong-arm them in any way.
