ok so I have an old lady that's blind and deaf. she owes me 12 grand in back rent. she has a living will from when her parents passed on. her cousins the trustee of her living will he always sends me the rent except for the 300 dollars and I told him over and over how much the rent is!! and she has been speaking with a lawyer and served her daughter but she can't get her cousin served so that she can get her court case over with.

This is a dumb question give the 3 day notice and start the eviction

If you've been underpaid $300 month for over 3 years (as seems from what you've posted) why on earth haven't you yet got your own attorney involved? Not sure what you expect from forum participants - you need an attorney.

I'm not going to let any tenant get 12K behind in rent. I would have filed for an eviction for non-payment long ago.

I am not taking on the problem of some other family's dysfunction. I am not accepting any excuse for non-payment of rent. I will not be adopting any of my tenants and taking over supporting them.

Incidentally, it is BS that the tenant can't get her cousin served. All it takes is to pay a process server.

Or, if she is not getting her income, she can hire a lawyer and petition to have a court appointed guardian take over managing her trust.

None of which makes any difference to me. That tenant would have been someone else's problem long ago.

I feel sorry for the lady, sorry but I do. Its not your job, but before it got this far behind, I would have helped her legally get the money she needs. Sounds like the cousin is ripping her off. Not only is this lady elderly, but blind and deaf, she needs help! Isn't there a elderly abuse org. that might help?

My job or not, if I see this type of abuse, I'd report it. Does she have enough coming in to properly feed and take care of herself? If not, again, this is elder abuse. Someone needs to check the books and find out what this cousin is doing with this woman's money. It might be directed that they receive what's left after she passes, so they're making her live on the cheap. Or they're helping themselves to part of her monthly allotment.

I hope you can report it to the proper authorities and not only get what's owed to you, but help her in the process.

Why on earth would you accept rent that is short $300 for.....let me do the math.....40 months or over 3 years?

I'm just speechless over this one.

I'm wondering if accepting the shortfall for as long as they have without moving to evict, if it may be viewed as an acceptance and agreement to the lower rent amount.
