But seriously, if they arent causing any trouble, why even bother with trying to take action against people that arent hurting anyone? Would you prefer a wife-beating drunk to live there instead? At least he's not smoking pot, right.
Besides, if you have no proof, the cops will tell you the same thing. If the place still smells like weed or whatever, just take it out of their deposit.

txdemo- I'm trying to take care of my investment. I worked long hours, saved my money, did lots of the fix-up myself, I sacrificed to buy this rental. I post items I need help with, feedback with, if you don't help don't reply. I'm asking here first to avoid continually paying an attorney.

To everyone else - currently in Texas it is illegal to smoke that. I want to protect my investment and yes, I do not want the house to smell like smoke when they leave, esp an illegal substance. This post isn't about why it is bad or not. It is about land lord rights and to protect his property.

Because I want to protect my investment, plus not be an ahole, i've asked them to do any smoking outside. I guess for future leases I will put NO SMOKING period.

Because there is no Philip Morris or Anheuser-Busch (or whatever their now sanitized corporate takeover names are now) to lobby Congress (translation: $$$$) for legalization of pot, like they've done for cigarettes and alcohol.

You're right. I jumped the gun. I just saw multiple posts about things that landlords should already have knowledge about and thought you were trolling. You're a new landlord so it's understandable. Sorry about that.

LandlordLu, all you can do is enforce the lease. No point in making enemies with the people that pay you. If nothing is stated in the lease, there isn't much you can do. You could casually bring it up and advise them to smoke outside, however anything beyond that isn't fair game.
