If a renter's negligence in maintaining the furnace causes an explosion/fire and the furnace must be totally replaced, will renters liability insurance reimburse the landlord?

Talk to your property insurance agent, they should be able to advise you and possibly even provide some assistance in resolving this issue.

Thanks- got a call in, he was gone for the day. Looks to me like the filter wasn't cleaned/changed timely and caused the furnace to short out and start a fire. Not a good holiday.

are you talking about a tenant owned policy or one you own ?

just make sure you are not using homeowners to cover a rental .it could be questionable . you need landlord insurance .

a dirty filter will not explode a furnas . there are high limit switches that shut it down prior . highly unlikely that is what happened . more than likely the motor shorted or tight bearings or even a fuel leak ignited something but this filter claim is likely mythical .

dollars to donuts this is not the tenants fault regardless of the filters being changed or not . if dirty filters caused fires 3/4's of all housing would have gone up in smoke .

sorry to say this one is likely on you and your insurer if they cover it .

Yeah. That’s not covered - has to be direct negligence. A dirty filter isn’t the cause.

You go through your own insurance and let them go after the tenant if they think the tenant can be held responsible.

A renter's policy should cover the tenant's negligent cause of smoke, fire or explosion to the premises if you can prove that the tenant's negligence was the proximate cause of smoke, fire or explosion.

Whether the owner's insurance company can go after the tenant in subrogation depends on the state. Laws vary from state to state and many states prohibit it and many allow it.


Would help to know what state the property is in.

And smart LLs would therefore not leave this up to tenants.

Best LL I ever had owned about 6 duplexes, and took care of the furnace filters himself. Not because he thought the furnace would explode if he didn't, but because he liked to make sure the furnaces were properly maintained - since, after all, the furnaces and ducting belonged to him.
