But Judge Friedrich also stayed her own ruling just days after making it. So on one hand she said the CDC doesn't have the authority under the Act cited, but on the other she said there is sufficient evidence to support the need to maintain the eviction mortarium based on public health and safety grounds of that Act. So maybe she feels the CDC lacked the authority to be the agency issuing the order while upholding that the moratorium is legit under the Act. Sounds like a punt to the US Supreme Court which doesn't appear to want to decide until after the moratorium clock has ran out.
Bottom line is that the moratorium is going to have to end some day. And it's going to be ugly regardless of when it ends. You might as well end it now given the increased vaccination rate and folks continuing to go back into the office.

Not surprised how Roberts voted. Kavanaugh's explanation was promising for potential future votes on the issue by him if the administration does try to extend beyond the end of next month for whatever reason, but his vote here still disappointing. Good on Thomas, Gorsuch, Alito, and Barrett.
