Hi, my current landlord claimed he was the broker when I was reviewing the apartment. He claimed he was only the broker; when asked multiple times during the viewing and signing of the lease. After I had already paid the broker fee of $1,400. He continued to claim he was the broker. Now I found out he is the landlord and charged me a broker fee. I paid a broker fee, security and 1st months rent. How do I go about getting my money back for the broker fee?

Location? It is generally illegal for a landlord to charge a broker fee for units they own but details matter. You need to research landlord/tenant law to find out how to file a complaint in your area. Don't do anything such as withhold rent until you're sure of the specifics.

To be a broker don't you have to have a realtors license? What he did just doesn't sound legal, call your state about this.

I'm sorry but that's funny! It's NYC and it has been that way for a long time. I just happened to find my own place there and still had to pay a brokers fee. It's normally a full months rent. And it was worth it because it ended up being a great place to stay when I had to be in the city.

Yeah I live in The Bronx, NYC. He is now claiming that he is a realtor. But has not shown proof of it. He owns the home and lives upstairs. He kept claiming that it was his family that lived upstairs, that is why he is always over the apartment. He claimed he lived in Staten Island.
