Yes, I think that all of those people affected should consider a class-action lawsuit against the ACC. Or just tell the ACC "See you in court" and watch their attorney try to find anything in the covenants which grants the powers being claimed.



My wife and I traveled 2000 miles cross-country in an RV for our move and were planning on keeping it, parked neatly by the side of our house (a fairly modest 28 ft. A-class). That was one thing I had checked the covenants on very carefully, having heard of so many problems from other people elsewhere. As it turned out, we didn't keep it, otherwise we'd likely be getting ready to do battle as well.

So, would you reconsider living in this HOA?

I think if I'd known about the way the ACC is trying to exceed its powers, then I would certainly have been more reluctant to move here, especially given that I was quite opposed to living in any sort of HOA area to begin with (there's a whole thread about the white fences issue over in the northwest Arkansas forum).

Having lived here for almost 2 years now though, I have to say that this is the best place within the immediate area to live overall. The area is growing rapidly, and the other nearby towns are already extremely busy and looking set to become more so. My wife and I like the peace and quiet of living in a semi-rural area, but without being too far away from facilities as we're now in our mid fifties. If we didn't live here, I'd want to find somewhere in a different part of the state (and we have relatives elsewhere in Arkansas).

The POA (HOA) itself isn't the problem, and for $37/mo. we have nice trails, lakes, and other facilities, and the POA does maintain everything nicely. Ultimately I know that the ACC can't enforce anything which the restrictive covenants don't give it the power to enforce (and there are some things which are pre-empted by legislation as well), but who wants the hassle of having to argue about it?
