To an extent, that's apples an' oranges. Since the job function doesn't require close private/semi-private contact with juveniles as part of the work routine, you can't extend the same oversights/concerns on a grocery store as you can a child care provider/teacher/school staff member. Now, to be sure - a pedophile working in a grocer WOULD concern me - but from what I can see, the suspect had no prior history of this kind of behaviour, so I fail to see any liability that can reasonably be visited upon the employer (not that you said they were, just speaking generally).

Further - it's apparently the claim that this was consensual, so there's little reason to think that anyone in/at HEB would have seen anything to make them suspicious (let's face it - if I see a little girl with an older guy like that, I'm gonna think sister/niece, etc).

I see your point. Except a 12 year old "consenting" is where I have the issue. True he may have not had the record before but he sure has one now!! I'm pretty sure regardless of his sentencing HEB will be letting this employee go.

Oh, to be SURE! No way in blazes that a 12 yr-old is in ANY way cognizant enough to give that kind of consent at that age - period. I was just referring to what the average persons' reaction would be seeing the two of them together simply walking about.

I hope his record will be a moot point because a jury will sentence him to jail for life.....

But the thing is he had no restraint to resist the urge to have "consensual" sex with the 12 year and given the fact they were engaging in sex in public places such as a school and parking lot.....it just adds more shocker to it. I'm not sure how long it took for the parents to see this but if they hadn't caught on in it.....it would still be going on right now. Don't you think? Can someone tell me exactly why the parents got suspicious in the first place.....what really tipped them off? Going to the store repeatedly doesn't make sense. I think there is more to the story than what is given by the news. Hmmmmm....nonetheless he made the biggest mistake of his life. HEB is a good employer and now I'm not sure where pedo's get employed these days and thats if they do.....but it's a tough economy and jobs are scarce.....he called it in and gave up on life for a 12 year old. SHAME!!!

For what cause of action? You can sue anyone for anything, but an action against HEB would be laughed out of court.

again I'm not saying she should sue. I am simply stating in this day and age it is POSSIBLE that the parent will try to because she was meeting him there.

Considering a women recently filed a suit against an airline for a turbulent flight that caused her "stress", it's a definite possibility there could be a law suit here.

Prime example of the crap that clogs up our court system. If it doesn't pass the common sense test then it shouldn't be allowed to proceed. In fact, people like that should be fined for wasting the court's time for even thinking about it.
