So we rented a small apartment in San Francisco and we sign and gave our deposit in December. The rent we have until February because it was when the landlord said we could move in. But the apartment was not ready we ended up movin in March the week of our wedding During that week the landlord told us we could go find another apartment if we wanted to we obviously had no more time. So we took it we did all the repairs because the repairs she did were far from acceptable. Now we got the opportunity to move to a better place but we want our deposit back is it possible under law to get it back if the contract and deposit were givin in December?

I think they can take it for time that the place goes unrented to make up for the rent you would've been paying. In today's market you would expect it shouldn't go for long, but I would imagine they would keep at least some of your deposit for that.

What is your lease term? If it's month to month you can move out with 30 days notice, if it's for a longer period you are on the hook for the rent from the time you move out until it's rented, the only exception would be if the lease has some other form of remediation for breaking the lease.
