I bought into a 3 unit condo and my unit has a deck attached to it. I just found out my deck sits in the common area backyard. The other owners have asked that I remove the deck. Do I have the right to keep it?

If the deck is on your property, and is a part of your property....... I would think it's your choice if you want to remove it or not, not random neighbors.........

The common areas in any PUD (planned unit development) are defined by the CCR’s.
The CCR’s will define exactly where the common areas are and what restrictions (if any) exist pertaining to their acceptable use.

In the PUD we live in, the common areas are for the use of all owners and there are specific restrictions. For example, we cannot store items there, dump trash, leave toys/bicycles there, hold loud gatherings, or even make excessive noise there.

Based on my experiences, the common area is for the use of all the owners. I think your deck needs to be removed/moved so that it is not in the common areas.

Check your CCR’s for specifics.
