Hi all,

I bought a used car recently, early 1990's year. The seller told me the car needed a smog check soon. I said that's fine, and I purchased the vehicle anyway. Everything is settled, and I'm the new owner of the car. However, the car didnt pass the smog check I recently did. The purchase was made 15 days ago. I bought the car even though I knew it needed a smog check. Is there anything I can do to that could help me to get my money back?

Did the car have a valid (unexpired) smog check document when you bought it? If yes than everything looks OK legally and morally. So sorry but treat it as a life lesson.

If car did not have a valid smog check on a day when you bought it, that's a different story but seems like it's not your case.

Do a search on this site (under CA) for "smog". You'll find all the info you need. The seller is responsible for getting a smog certificate (i.e., the car passed).

The seller told me it passed smog a few months ago. What do you mean unexpired? I know the guy isn't trying to screw me over or anything, it's just I maybe should have done the smog check before I purchased the car.

Smog checks are 'valid' for 90 days (they can be used for the annual registration, or for the sale of a vehicle). It is the *seller's* responsibility to provide a valid smog certif.

I think you are trusting the seller more than you should. You need to protect yourself.
