I took a part time bookkeeping position working 25 hours per week after being on unemployment for almost a year. I have worked in accounting for more than 30 years and is all that I am familliar with. Job was listed as " expecting our bookkeeping house to be kept in excellent order which includes being timely in completing your responsibilities and paying attention to the details". This is a retail store. In interviews bookkeeping duties were discussed. It was also brought up that I was expected to learn the front counter (sales) so that I could help if the store got to busy or they were short staffed. At no time was I told that I would be scheduled every day for 1 hour to be at front counter. These hours fluxuate daily. This happened after I had been employed about 1 month. I asked if this was going to be an on going thing until I learned it or was it permanent. Reason for asking was that I have back problems and cannot stand for long periods of time. Was told that this presented a problem and that if they had known of my back problems they would not have offered me the position. I told them that if I had known I would not have accepted position. To make a long story short they got me a stool to sit on. This does not solve the problem of not being able to complete my bookkeeping duties as I cannot do them at the front while ringing out customers. Boss cannot understand why my work is not getting done and am constantly harrassed about it. Small store 6 employees. I am not comfortable in being a retail clerk and have found that I am not cut out for this type of position. If I resign my position how would that affect my unemployment?

At a minimum your benefits will be suspended if you're still collecting, and if not, it'll take a long time to find out if you qualify for UI.

The other problems are that the job wasn't as presented a year ago yet you kept doing it, so that is view as you accepted the terms of employment. The other is that you complain of back issues. Do you have recent medical evidence that the job as is is currently aggravating it? It can't be on your say so. Only a doctor can diagnosis a condition.

If you provide more info there might be some other loophole you can use to increase your chances for getting UI, but as it stands now, just continue to fail at your bookkeeping duties until you are discharged for poor performance. Then getting UI will be easy.

Thank you for your response. I have only been working there 2 months. It was only after being there about a month that I had to start at the front desk. At first it was only a few days a week which I assumed was part of traiining to learn that aspect of the business. It has only been in the past 2 weeks that it has changed to every day. Manager who is owner has used scare tactics on other employee's (threatening to fire them if they need time off or miss a meeting) so I am a little afraid to talk with him about any aspect of my job.

Talk to him then. Getting fired because he gets mad is not misconduct, and you'll get your UI.
