Hello,

The situation is I became unemployed after 30 years of working -never collecting unemployment.

In January of 2011 I started collecting unemployment.

In February of 2011 I went back to work until May of 2011. (I reported I went back to work and collected no benefits during this time)

I went back to collecting unemployment in May of 2011.

In late 2011 I started on my first extension.

When 2012 came I qualified for a brand new claim.

When the new 2012 claim ended, around July, I went into extended benefits , BUT they put me back on the extended benefits from the 2011 claim.

I am now on my final (4th) extension of my 2011 claim.

My question is : When this 4th extension ends from my 2011 claim , Will I be able to collect extended benefits from 2012 claim which I never collected extended benefits from ?

Thanks for any advice. It is very appreciated.

No. EUC benefit payments on the 2012 must begin before the benefit year end date of the claim. Your situation is common when there are two claims only a year apart in states which are paying all four tiers. Very often the EUC from the first claim is paid beyond the bye of the second claim. Thus, any EUC from claim 2 is lost.

Thanks very much for your help. Hard to get a straight answer from EDD. They should hire you to cut down call volume at EDD !

I wonder why they didnt start me on a new round of extended benefits after my newer 2012 claim ended ? Seems like it would have lasted longer and helped more ?

Because the extensions are federal money. Federal EUC regulations require states must test for new state claim eligibility and pay state funds before paying federal EUC. You apparently worked during your first benefit year and created eligibility for a new State of CA claim. Those benefits needed to be paid first. Happens all the time when people work while collecting UE.

I asked this same question directly to EDD. Here is part of the reply I got a few days ago :

Thank you for your inquiry. Once you exhausted the extended benefits on your 2011 claim, the department will start a new series of extensions on your 2012 claim if needed.

Id like to believe this, but I believe Ariadne22 knows more about unemployment rules than EDD does. When I ask EDD a question, Its either a short answer that has nothing to do with the question or in this case it is a nicely explained answer that actually has something to do with my question although it may not be accurate.

LOL - well the answer you got would be accurate IF your 2012 claim had not already expired. Unfortunately, the reps who respond to the emails rarely delve into the specifics of a claimant's situation.

If, by some bizarre happenstance, CA's computers goof and put you on the 2012 EUC, please do let us know. That would be a first for CA.

The answers you get on the email are the "general" ones. Usually this is what happens. Unfortunately, there are not enough people answering email for them to be able to get into specifics with each claim via email.

My question is..my first tier ended 2/9/14...hopefully they will pass for unemployment extension..do i have to reapply again or will they automatic restart my claim...my claim ends 8/14/14...thank you in advance for those who respond..
