My job is on thin ice right now. But I have been saying that for the last 3 years and I'm still here. I make about 60K per year. I want to get a part time job at night to pick up some extra money. IF I were to get fired from my main job, would the night work disqualify me from unemployment? I would make more from unemployment then I would from the part time work. I can not afford to jeopardize my potential unemployment benefits for minimum wage.
Alternatively, if I got fired from my main job, should I just quite the part time work on the same day?
Give me some guidance

Knowing your state would get you a better answer. However, I'm of the opinion that part-time work and UI benefits are the biggest rip off to the claimant, and that you should avoid it at all cost.

Sorry, its New York. Oh and I agree, there is absolutely no point in accepting part time work while on unemployment. BUT my question is not about that. I am still employed full time. I want to take a second job in the evenings. My main job is a little shaky. Im just trying to plan this out correctly in case I get fired from my main job. I can quit the second job the same day I loose the main job if I have to. I just dont want to disqualify myself from unemployment benefits

The general rule is that you'd have to quit your part time before you knew that you were getting laid off from your full-time job. Doing it on the same day would just be too coincidental. You might get away with it, but I personally, would not risk it.

So then, the only way to insure there is no problems is to not take a part time job at all(at least not on the books). Its really asinine, but thats the State of NY I guess.

Quits are always problematic. A quit on the same day as a termination will cause extra scrutiny of your claim.

Worst case, you could be denied.

Second worst case, NY may reduce your weekly benefit by the number of days you might have worked part-time. If you were working 3 nights a week, under NY's partial benefit formula you would lose 75% of your weekly benefit as even one hour of work a day is perceived to be an entire day's work, and under NY Code a "day's" work reduces your weekly benefit by 25%.

Don't do it.
