My husband just recently added me to his newly created LLC. He has not submitted for an EIN yet. I was just unemployed & would like to apply for NJ Unemployment. As I understand, it would be better if I am not listed as a member on his LLC. If my husband takes me off his newly created LLC & he does hire me to do some part time work to help him out, would it be okay if he adds me as an employee while I am still receiving NJ unemployment?
My other questions would be:
1.) By putting me on his payroll, can it become a problem when we file our income tax return, we usually file our taxes Jointly.
2.) Let's say if possible (& no issues) for me to work part time for my husband's 'single member' LLC (after he takes my name off), is it best to add me as his employee & put me on payroll, deduct payroll, SS, Fed, State, UI taxes & all that? In this case, should his LLC to be classified as a single entity only or is it better to be classified as a corporation?
