HI I had two jobs and lost my part time due to Covid i applied to see if i can get benefits and when i did my application both jobs came up I ONLY selected the part time that I lost and then started reciveing unemployment and now i get a letter stating that i owe 25000 they want all the money back i called and explanied that even though I am working i ony applied cause i lost one job any advise on this

Were you still working that second job? If so, were you reporting those wages each week you certified?

I was let go from second job but i was still working first job I had applied for second job but they still said that it does not work that way that I still owe it becasuse I had one job still

But you didn't answer the question as to whether you reported earnings from the first job while your were claiming benefits each week. You are supposed to report earnings each week which reduces your weekly benefit to a partial payment or if too high of earnings for the week a zero payment for the week.

that is where i went wrong when i answered the questions i answered to the specific job i lost so i answered no to them

normally it asks did you work the week of XXX to XXXX. it's not job SPECIFIC. you are to report your earnings.. obviously you were working and should have reported your earnings for all the weeks. additionally they may have hit you for fraud statements for each week that you claimed for failure to report your earnings.

Bottom line you owe them the money back.

Yes that was told to me after the fact but I did call and one lady said to answer them accordinally to the job i lost.

You can appeal the overpayment. At the hearing, just provide the date, time and name of the unemployment representative who instructed you to only report wages from the former employer while disregarding everything in every bit of unemployment manuals, web site, state regulations, claim form etc. to report ALL wages. Hopefully the ALJ will be able to confirm your version of events and decide to write off the overpayment. Otherwise, you owe the money and need to pay it back.

If labeled fraud (which failing to report wages is fraud) fines, penalties and interest can cause overpayments to skyrocket. If the feds also want any pandemic money back, that and state benefits would be over $1,000 a week alone. Fraud is a mean mamma!
