Recently in Madison or Green county (not sure which), I drove through a construction site. The flagman stopped me and told me I was driving too fast and was going to report me to the state police. Can I receive any kind of a ticket by mail based on something like this? There was not policemen present.

Bob

I've often thought it would be awesome if one could turn jerk drivers in (I'd probably be able to do this daily around here) but as stated above a cop has to see the infraction.

Many jurisdictions allow tickets to be issued based on a photograph from a traffic camera. There is no proof of who was driving. The ticket is sent to the registered owner of the car.

We went through this with one of our cars our son & his friends drove through Maryland. One of the friends was driving too fast in a work zone. We tried contesting the ticket. In Maryland, unless you Id the driver and send info such as that person's driver's license number and state, Maryland won't let you off. Maryland expects the owner of the car to do the police work that should have been done by a Maryland law enforcement officer. No points show up on the owner's license.

I think it is highly unfair. But it is easier to pay the fine than go to court to fight it.

I do not know whether Virginia has given highway workers the authority to report such incidents. It seems unlikely, however.

That is different, there is proof from a camera

No, it is not different. The camera takes a photo of the license plate. Maryland sends you a copy of the photo. The photo does not identify the driver. The state of Maryland assumes that one of the registered owners is the driver of the vehicle at the time that the photo is taken. The vehicle involved in this incident is titled to my name and my husband's name. But because his name appeared first on the title, the ticket information was sent to him.

Interestingly, Maryland generates driver's license numbers based on full name and DOB. If the person happens to live in MD, you could generate their driver's license number using this guy's website. (It worked for everyone in my family when I lived in MD)

I think the fact that they do not assess points on these infractions points to the fact that they are much more interested in revenue generation than keeping people safe.

All parties involved reside in Virginia & have Virginia licenses.

Scottfs, I think you are right. This is more about generating money.

The Flag man is a dullard. The only ticket that comes in the mail in Virginia is from the couple areas that use red light cameras.

Note: Virginia law requires the summons for a traffic violation be issued to you in person by a law enforcement officer.

So any red light ticket based off a camera that comes in the mail is voluntary to pay. Charlottesville had a story in the paper about this.
