I need some information on how to evict a roommate not on the lease. I have two months to go on my lease and I've already turned in my notice to vacate to the apartment management. I just want this roommate out, and I offered the person until the end of June to leave, but the person doesn't want to leave. This person was not my original roommate, and has never been on the lease. My understanding so far is that if I go to the court and get an eviction notice with sufficient time for the person to move out I should be protected from the majority of legal consequences. Is this true?
500 Indiana Ave., NW the landlord tenant court. File for eviction.
2 months is not enough time. It may take well over a year. DC has some of the most tenant protective laws in the country. If they've been "staying" there more than a few weeks you're SOL.
Best to start the paperwork. What does your landlord say?
If that person wasn't or isn't on the lease, you can kick that person out anytime you want. Sure, they can claim Tenants rights, but you can always threaten them with eviction, which will basically ruin their credit. I guess you have a choice here. You either do this peacefully, or do it forcefully. Either way, it's going to be a headache, and if you decide to evict this person, that person's life's going to be basically messed up because of you.
How exactly does somebody live in your apartment without being on the lease?
If they are not officially living there and on the lease, then what right do they have to it? Tell your landlord you had a break-in and ask for the locks to be changed. Put their stuff outside on the curb.
I don't think that you can evict someone; the apartment management/landlord would have to do it.
