OK peoples, explain to me how fair this is. Here goes: I work for a local government. We are a 24/7 operation (emergency services). Naturally, we work shifts. I work 4 ten hour days per week, Wednesday - Saturday. A coworker of mine happens to work the same hours but from Sunday - Wednesday. Our employer defines the week as beginning on Sunday morning (sat night) at midnight and ends on Saturday night at 11:59p.m.

OT is any hours worked over 40 hrs at time and a half (the norm). Holidays are payed at the holiday rate, which is also at my time and a half.

Now, I come in on Monday for an extra 10 hr. shift. I then complete my workweek Wednesday - Saturday. Here's the kicker, Saturday is a holiday. I will be paid straight time for Monday because that is the first day of the week that I am working. Then I will be paid straight time for Wednesday, Thursday and Friday. Saturday (the holiday) will be paid at time and a half - and that's all.
Let's say for my coworker's example, Monday is the holiday. She worked Sunday - Wed. and then came in for an extra shift on Friday. At the end of her shift on Wednesday, she had already worked her 40 hours. She will be paid time and a half for Monday (holiday rate) and then OT for Friday. To me I should be paid OT for Monday (remember, I came in on my day off) and then Saturday should also be paid at the holiday rate.

I am being penalized for working the back half of the week. Why aren't we paid the same? We both worked a 50 hour week with a holiday falling on our normal workday. I should be getting OT for any hours worked "outside of my normal workweek". The employer says no. The clock starts on Sunday and ends on Saturday.

You're being penalized only when the holiday occurs on Saturday. When the holiday occurs earlier in the week, you reap the benefits while your colleague does not. Stick around a little while longer and it will all balance out.

I agree with kodaka, it will all come out even in the end. Rules are rules when it comes to payroll, they are all set up to prevent someone from taking advantage. Choose your overtime days carefully to maximize the financial benefits.

Is the holiday Saturday or Monday? Obviously that makes a difference!

I'm not following this.

I'm assuming you get paid holiday pay only if you actually work that day.

You should both be paid the same. It should not matter what day the holiday falls on as long as the days you are talking about are within the seven day pay period.

If you make $1.00/hour your pay would be $60.
