A gay refugee from Congo was granted asylum in the U.S. just recently, and there was a big welcome fundraiser for him in SF yesterday.

By international protocol, a refugee is a person who is outside their own country's territory owing to fear of persecution on protected grounds. Protected grounds include race, nationality, religion, political opinions and membership and/or participation in any particular social group or social activities.

According to Wikipedia, any person may seek asylum, and the nation may deny it as not meeting the above criteria. Homosexuality would appear to meet the test of "social activities". It is not against the law in Africa to BE a homosexual, but only to practice homosexuality as a social activity. Presumably, "persecution" would have to be serious enough to endanger the life or liberty of the refugee. Obviously, the social activity would need to be at least legal in the asylum country, so there is no point in seeking asylum claiming you are persecuted for embezzling funds or producing child porn.

In the USA, asylum requests are assigned at random to adjudicators, who exhibit a huge amount of personal discretion as to who is admitted to refugee status. Generally, they are sent back home to government which are favored by official US policy, no matter how brutally repressive, but not back to countries that America perceives as unfavorable (i.e., socialist).

US Refugee policy has nothing to do with sexual orientation. We accept refugees from socialist countries, and send back those from countries where they will be tortured and murdered by thugs that oppose socialism. That is usually the first criterion.

You might want to take a look at Western European countries' policies (quotas, language, self-sufficiency)... Iceland's (language requirements), Australia (self sufficiency, large savings) ...

It's not just gays being persecuted - Some back water African nations are absolutely barbaric..and tribal hate and strife have been on going for hundreds of years. I was curiously cruising Youtube videos when I came upon the most disturbing and disgusting vision that I wish I had never laid my eyes on. A rural group of Africans had cornered a few men...They were slowly burning them alive and beating on them as they burned with clubs...The gay issue is not even an issue..There are such human rights abuses that gay persecution is a minor problem in comparison. There are places that exist that are hell on earth.

Honestly, it never crossed my mind that there are also gay Africans. I know it sounds silly as there are gays everywhere, just that I always see African men to be strong, muscular and very manly.
