I need to know if I'm entitled to overtime pay if I work around 80 to 90 per week but I'm salary employee. Arizona Labor Board already approached my boss but only certain employees got some money from this outcome.

Government contracts "may" require either overtime or compensatory time, depending on the type of contract. If your company bills your client for each hour worked, you should receive OT or comp time. However, if it is a fixed price contract, that may not be the case.

If you are a salary or "exempt" employee then your employer is not required to pay overtime. However there are guidelines that your employer has to follow in classifying someone a salary employee. The guidelines fall under the Fair Labor Standards Act or FLSA. Some research on your part can determine if the guidelines have been followed.

AS the other poster said, there are guidelines that have to be followed. Did you say that Wage & Hour had already been in the company ? there are salary and responsibility issues. Just calling someone "Salaried" or "supervisory" doesnt cut it. At a company I worked for, we had an "irregular workweek" for our "salaried" employees and they were the clerical staff. It was all perfectly legal. Good luck.

Default Again, thanks to all

Basically this is a seasonal job (produce) and we were averaging 15 to 18 hours per day. When the labor dept. showed up the floor crew did get some money after an investigation but the crew at dispatch (like myself) got a big zero. I dont know if we were categorizied as management or what.

Contact the FEDERAL Dept of Labor office in your city. We had a client here who was audited first by the state, then by the Feds....results were different. Since NM has very few labor laws, the Fed audit trumped the state audit. Could be the same way in AZ.

Federal laws do control most of this sort of thing. I would contact DOL office in Phoenix, Wage and Hour Division.

I was in somewhat the same position, contacted a FLSA attorney and ended up getting a HUGE settlement. Realize you will most likely lose your job but I figured I didn't want to be slave labor anyway.
